Washington and Lee law professor Erik Luna made his second appearance before the House Subcommittee on Crime, Terrorism, and Homeland Security last Thursday. His testimony was on the issue of federal funding for indigent defense. You can read his testimony by downloading a pdf file here. While Luna supports efforts to require states to meet their Sixth Amendment responsibilities, he objects to the creation of a new federal agency, the National Center for Defense Services, and worries that such an entity would become a policy making body with powers outside the established Constitutional framework. Eric’s first appearance in front of the committee was in March, and he talked about it with Peter Jetton of the law school at that time.
